LEGAL NOTICE AND GENERAL TERMS OF USE

2. SCOPE OF APPLICATION

These provisions (hereinafter, the "Terms of Use") govern access to, navigation of and use of the Website that the Partner makes available to Internet users.

Access to and use of the Website confers the status of user of the Website (hereinafter, the "User") and implies full and unreserved acceptance of all provisions set out in these Terms of Use. Accordingly, the User must read these Terms of Use carefully each time they intend to use the Website, since the Website and its Terms of Use may be amended. If you disagree with their content, you must refrain from using the Website.

This Website is primarily aimed at users residing in Spain. The Partner does not guarantee that the Website content is appropriate or available outside Spanish territory. Any access from other countries is the sole responsibility of the User, who must ensure that such access and browsing comply with applicable local regulations. The Partner assumes no liability arising from such access.

The Partner reserves the right to amend these Terms of Use at any time and without prior notice. The new terms shall apply from the moment they are published on the Website.

3. CONDITIONS OF ACCESS AND USE

Access to the Website is, as a general rule, free for all users, except for the cost of the connection through the telecommunications network provided by the access provider contracted by the users. However, some services or features may be reserved for certain Users or subject to prior registration or payment of a fee, which will be expressly indicated on the Website.

Only persons of legal age with sufficient legal capacity to bind themselves under these Terms of Use may use the Website. The Website is not intended for minors, and the Partner disclaims any liability arising from access by users who do not meet this requirement.

Access to the Website is the sole responsibility of the User. It is the User's responsibility to ensure that the Website's content meets their needs.

The User expressly undertakes to use this Website diligently, responsibly and in accordance with the applicable legislation, these Terms of Use and any rules established from time to time. Improper use of the Website may give rise to liability towards the Partner or third parties.

3.1 General use of the Website

Any use of the Website for purposes that may harm the interests or rights of the Partner or third parties, or which may affect, overload, disable or impair the computer systems, networks or applications of the Partner or other users, is expressly prohibited.

3.2 Use of content

The User undertakes to use the Website content in accordance with applicable regulations and the conditions set out herein. In particular, the following is prohibited:

  • Reproducing, copying, distributing, publicly communicating, transforming or modifying the Website content, except where express authorisation has been granted by the rights holder or where permitted by law.
  • Copying or reproducing for private use content protected by intellectual property rights, such as software or databases, where this entails unauthorised reproduction.
  • Extracting or reusing, in whole or in part, the Website content or the databases made available to users.

3.3 Forms and submission of information

The use of certain services may require the submission of forms or personal data. In such cases:

  • The User undertakes to provide truthful, up-to-date and accurate information.

3.4 Links to the Website from other websites

Any person or entity wishing to include a link to this Website must meet the following requirements:

  • No false, inaccurate or incorrect statements may be made about the Partner, their team or the services they offer.
  • It may not be implied that the Partner has authorised or endorsed the link, nor that there is any relationship between the sender and the Partner, except with express written authorisation.
  • The Partner's trademark, logo or other distinctive signs may not be used without prior consent.
  • The website containing the link may not host unlawful content, contrary to morality or public order, or content inappropriate to the Partner's activity.

The User shall be liable for any damage caused to the Partner or third parties as a result of breach of these obligations. The Partner may adopt the technical or legal measures necessary to prevent, limit or remedy the consequences of unlawful conduct, and exercise any legal actions deemed appropriate.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

All elements that make up the Website —including, but not limited to, texts, images, photographs, videos, graphics, distinctive signs, logos, icons, interfaces, software, source code, design, structure and other content— are protected by intellectual and industrial property rights and are the exclusive property of the Partner or of third parties who have authorised their use.

Access to, navigation of or use of the Website does not in any case imply assignment, waiver or transfer, in whole or in part, of the aforementioned rights. The User may only view and use such content in a limited manner, strictly to the extent necessary for the correct use of the Website.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the Website content is expressly prohibited without the prior and express authorisation of the Partner.

The Partner reserves the right to modify, delete or update at any time the content, services and configuration of the Website, as well as to limit or interrupt access to it.

If the User believes that any content infringes intellectual or industrial property rights, they may notify the Partner through the contact details provided in section 1 of these Terms of Use.

5. RULES FOR PUBLISHING COMMENTS

The Partner reserves the right to remove, without prior notice, any comment or content contributed by Users that contravenes applicable law or that, in the Partner's judgement, is offensive, discriminatory, inappropriate, or contrary to principles of coexistence or respect.

The Partner shall not be liable for opinions expressed by Users through comments or other participation tools enabled on the Website.

By publishing content on the Website, the User declares and warrants that:

(i) they are the author and holder of the rights over the content;

(ii) its publication does not infringe third-party rights, including copyright, trademarks, privacy or image rights;

(iii) they have settled all necessary payments and licences over such content; and

(iv) they have sufficient legal capacity to accept these terms under the applicable law.

6. DISCLAIMER OF WARRANTIES AND LIABILITY

6.1 On the information published

Access to the Website does not in any way imply that the Partner is under an obligation to verify the truthfulness, accuracy, adequacy or timeliness of the information published. The Website content is for general informational purposes only and does not constitute legal, tax or any other professional advice.

The User should not make personal or business decisions based solely on the information offered on the Website. The Partner accepts no liability for decisions taken based on such information or for any damage arising from actions based solely on it.

6.2 On service quality

The Partner does not guarantee the absence of viruses, malware or other elements that may cause disruption to the User's IT systems (software and hardware) or to stored electronic documents and files. It is the User's responsibility to have appropriate tools for the detection and removal of such elements.

The Partner is not responsible for any damage caused to the User's or third parties' computer equipment while browsing the Website.

6.3 On Website availability

Access to the Website depends on services provided by third parties, such as telecommunications network providers, whose continuity, quality and reliability are beyond the Partner's control. The Website may therefore be suspended, cancelled or interrupted without prior notice.

The Partner shall not be liable for any damage suffered by the User as a result of interruptions, disconnections or failures in such third-party networks or services.

7. LINKS

7.1 On links to third-party sites

The Website may contain links to third-party websites (hereinafter, "Linked Sites") in order to facilitate access to information available on the Internet. In such cases, the Partner acts as a mere intermediary, in accordance with Article 17 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), and shall only be liable for such content if they have actual knowledge of its unlawfulness and have not acted with due diligence to remove it.

The existence of Linked Sites does not imply any agreement with the owners of such sites, nor approval or endorsement by the Partner of their content or services.

The Partner has no control over the content and services hosted on Linked Sites and therefore assumes no liability for damage that may arise from their unlawfulness, inaccuracy, unavailability, outdatedness or any other aspect not directly attributable to the Partner.

7.2 Procedure in case of unlawful content on Linked Sites

If the User or any third party detects that any of the Linked Sites directs to unlawful, denigrating, violent content or services contrary to morality, or which infringe third-party rights, they may notify the Partner including:

(a) Their personal details (name, address, phone and email);

(b) A description of the content or service considered unlawful or inappropriate;

(c) In case of infringement of rights (such as intellectual property), the details of the rights holder and documentation proving their standing or, where applicable, representation;

(d) An express statement of the truthfulness of the information provided.

Receipt of such notice shall not, under the Spanish Information Society Services Act (LSSI), constitute actual knowledge of the activities or content referred to.

8. APPLICABLE LAW AND JURISDICTION

These Terms of Use are governed in all respects by Spanish law.

In the event of any dispute concerning the interpretation or application of these terms, the parties shall seek to resolve it amicably and in good faith. If no agreement is reached, the parties shall submit to the courts and tribunals that apply under the current legislation.
